By accessing or using DailyHigh ("the Service"), operated at dailyhigh.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

DailyHigh provides real-time weather observations, forecasts, and temperature prediction intelligence sourced from NOAA's Aviation Weather Center and The Weather Company API. The Service is designed for informational purposes only.

3. Disclaimer

The information provided by the Service is for informational purposes only. Any decisions you make based on information from DailyHigh are solely your own responsibility. Past performance of predictions does not guarantee future results.

4. Accounts & Subscriptions

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Paid subscriptions are billed monthly through Stripe. You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellations take effect at the end of the current billing period.

5. Refund Policy

Due to the nature of digital services, refunds are generally not provided. If you experience a technical issue that prevents you from using the Service, contact us and we will work to resolve it or issue a refund at our discretion.

6. Data Accuracy

While we strive to provide accurate and timely weather data, DailyHigh makes no warranties regarding the accuracy, completeness, or reliability of any information provided. Weather data is sourced from third-party providers and may contain errors or delays. DailyHigh is not liable for any losses arising from reliance on this data.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or redistribute Service data
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with third parties
• Resell or sublicense access to the Service

8. Intellectual Property

All content, branding, and software associated with DailyHigh are the property of DailyHigh and its licensors. You may not copy, modify, or distribute any part of the Service without prior written consent.

9. Third-Party Services

DailyHigh relies on third-party services including NOAA's Aviation Weather Center and The Weather Company (for weather data), Supabase (for authentication), and Stripe (for payments). DailyHigh is not responsible for the availability or performance of these third-party services. DailyHigh is not affiliated with NOAA, The Weather Company, IBM, or Weather Underground.

10. Limitation of Liability

To the maximum extent permitted by law, DailyHigh and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits or data, arising from your use of or inability to use the Service.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
